Depletion of Central Valley’s groundwater may be causing earthquakes

McVey Insurance, CA, GroundwaterFor years, scientists have wondered about the forces that keep pushing up California’s mighty Sierra Nevada and Coast Ranges, causing an increase in the number of earthquakes in one part of Central California.

On Wednesday, a group of scientists offered a new, intriguing theory: The quakes are triggered in part by the pumping of groundwater in the Central Valley, which produces crops that feed the nation.

“These results suggest that human activity may give rise to a gradual increase in the rate of earthquake occurrence,” said the study published in the journal Nature.

Using new GPS data, the scientists found that mountains closest to California’s thirsty Central Valley were growing at a faster-than-expected rate compared to nearby ranges. The growth spurt — about 1 to 3 millimeters a year — was enough to lift them by half a foot over the last 150 years.

Groundwater is very heavy, and its weight depresses the Earth’s upper crust. Remove the weight, and the crust springs upward — and that change in pressure can trigger more small earthquakes, the researchers said.

“It reduces the forces that are keeping the fault clamped together — leading to more small earthquakes during dry periods of time,” said Colin B. Amos, assistant professor of geology at Western Washington University, the study’s lead author.

Other scientists studying a seismically active area of southern Monterey County near Parkfield observed that there tend to be more earthquakes during dry months than during wet months. The number of earthquakes there every year has roughly doubled between 1984 and 2005.

“During wet periods of time when the fault is loaded down, the forces that are keeping the fault clamped down are greater. It inhibits the sliding of the fault,” Amos said.

But the question as to why earthquakes have been increasing in Parkfield over time has been a mystery. The groundwater theory introduced by Amos and his colleagues gives one possible answer.

“Over the long term, because we’re losing more groundwater, it could give rise to more seismicity by reducing these overall forces,” Amos said.

Groundwater has been slowly depleted in the Central Valley to quench the thirst of farms and cities since the mid-1800s.

CLEAR EXPECTATIONS HELP AVOID COMPLICATIONS

McVey Insurance, CA, ComplicationsA review of many lawsuits and claims against firms in the construction industry reveals that one of the key causes of disputes, and thus litigation, can be summarized as “unmet expectations.”

Whether it’s a clear case of the contractor failing to deliver what was promised (such as work that doesn’t meet project specs), or an evolving standard on the part of clients (workmanship issues), an unhappy client/contractor relationship creates a fertile breeding ground for allegations of liability. Although we review your Liability coverage program and needs regularly, good risk management also requires other measures to help minimize or prevent such actions.
For example, when negotiating agreements, it’s crucial to define project parameters clearly. Never begin work until the agreements are completed fully. According to one industry study, companies experienced far more claims when they provided services before a completed agreement.

It also helps to be selective in choosing clients. A potential client’s history of past litigation, complaints against you or other contractors, and their reputation for fairness and financial stability all indicate what you can expect in future dealings. If there are one or more red flags, proceed with caution.

Beyond the specifics of any agreement, it’s also critical to manage the client’s expectations. Although it might be tempting to brag about how great the final product will be and list numerous examples of superior work during the negotiation (and pricing) process, the fact is that the higher the client’s expectations, the greater their dissatisfaction when you don’t meet those expectations. Be clear about what you can accomplish within a given budget and the effects of making changes once the job is underway. The more the client is prepared to accept what happens during a project, the less likely that they’ll immediately go to the mattresses once a problem arises.

It’s always better to negotiate expectations with your clients now, than to have their attorneys negotiating settlements later.

How to Think Like A Wise Person

McVey Insurance, CA, WisdomIf I asked you to judge how smart someone is, you’d know where to start. But if you were going to assess how wise that person is, what qualities would you consider?

Wisdom is the ability to make sound judgments and choices based on experience. It’s a virtue according to every great philosophical and religious tradition, from Aristotle to Confucius and Christianity to Judaism, Islam to Buddhism, and Taoism to Hinduism. According to the book From Smart to Wisewisdom distinguishes great leaders from the rest of the pack. So what does it take to cultivate wisdom?

In an enlightening study led by psychologists Paul Baltes and Ursula Staudinger, a group of leading journalists nominated public figures who stood out as wise. The researchers narrowed the original list down to a core set of people who were widely viewed as possessing wisdom—an accomplished group of civic leaders, theologians, scientists, and cultural icons. They compared these wise people with a control group of professionals who were successful but not nominated as wise (including lawyers, doctors, teachers, scientists, and managers).

Both groups answered questions that gave them a chance to demonstrate their wisdom. For example, what advice would they give to a widowed mother facing a choice between shutting down her business and supporting her son and grandchildren? How would they respond to a call from a severely depressed friend? A panel of experts evaluated their answers, and the results—along with several follow-up studies—reveal six insights about what differentiates wise people from the rest of us.

1. Don’t wait until you’re older and smarter. The people with the highest wisdom scores are just as likely to be 30 as 60. It turns out that the number of life experiences has little to do with the quality of those experiences. According to the data, between ages 25 to 75, the correlation between age and wisdom is zero. Wisdom emerges not from experience itself, but rather from reflecting thoughtfully on the lessons gained from experience. Further research shows that intelligence only accounts for about 2% of the variance in wisdom. It’s possible to be quick on your feet and skilled in processing complex information without reaching sensible solutions to problems. Cultivating wisdom is a deliberate choice that people can make regardless of age and intelligence. Here’s how they do it.

2. See the world in shades of grey, not black and white. Imagine meeting a 15-year-old girl who plans to get married next week. What would you tell her?

Here’s a response that scored low in wisdom:

“A 15-year-old girl wants to get married? No, no way, marrying at age 15 would be utterly wrong. One has to tell the girl that marriage is not possible. (After further probing) It would be irresponsible to support such an idea. No, this is just a crazy idea.”

In contrast, wise people embraced nuance and multiple perspectives. Consider one answer that received high marks for wisdom:

“Well, on the surface, this seems like an easy problem. On average, marriage for 15-yearold girls is not a good thing. But there are situations where the average case does not fit. Perhaps in this instance, special life circumstances are involved, such that the girl has a terminal illness. Or the girl has just lost her parents. And also, this girl may live in another culture or historical period. Perhaps she was raised with a value system different from ours. In addition, one has to think about adequate ways of talking with the girl and to consider her emotional state.”

Beware: CGL policies don’t cover faulty work

McVey Insurance, CA, Commercial General LiabilityBuilders and contractors who buy Commercial General Liability policies with the impression that they will keep them safe from allegations of inadequate or faulty work should beware. It’s important to know that a CGL policy does not provide coverage for work that is faulty. In order to qualify for payment under a CGL policy, there must be a specific type of occurrence that causes property damage. The terms in a CGL policy define an occurrence as an accident. This includes repeated or continuous exposure to conditions that result in bodily injury or property damage. The damages or injuries must occur during the policy period in order to qualify for coverage. These injuries or damages must not be intentional. CGL policy terms specify that property damage is a physical injury to tangible property. This includes all losses of that property that happen as a result of the occurrence. It also covers the loss of use of tangible property that is physically unharmed.

When disputes arise as a result of defects in a building project, there are several factors that must be considered to determine whether the occurrence requirements and property damage requirements have been satisfied. The factors include the work or products that the contract states the policyholder was required to provide, the policy’s definitions, the alleged faulty construction job and the nature of the cause of the faulty work. These dispute conditions apply to defects in a structure sold or built by the contractor. They also apply to defects in a product that the contractor manufactures and sells independently.

If you have this coverage or are considering it, one of our agents will be able to analyze the policy’s terms. We will be particularly interested in the definitions of property damage and occurrence in the policy. This is crucial because each state’s law differs regarding such issues. Our agent will be able to advise whether or not the policy is in accordance with state laws. Some policies’ terms may indicate coverage for situations that a state’s laws may not provide coverage for. Keep in mind that state laws supersede anything written in an insurance contract. Some states specify that third-party property damage is a requirement for potential CGL coverage. Many states also specify that there is no coverage under a CGL policy for replacement or repair of damaged goods provided by the contractor. It’s also important to know that the work of a subcontractor is not covered under this law.

New Jersey was the leading state in addressing and defining defects in a CGL policy. A clear distinction was made between the replacement and repair of faulty materials. This was not considered as property damage covered under the CGL. However, third-party damage to a property may be covered. Since New Jersey’s definitions emerged, many other states have embraced the state’s view of business risks not counting as third-party property damage in the terms of a CGL policy. Modesto church practices radical hospitality with the homeless

McVey Insurance, CA, ChurchThe homeless men and women who turn up Sunday mornings at First United Methodist Church’s coffee and conversation program get more than breakfast. They sit together at tables so they can take the time to enjoy their food and each other’s company.

“They have decent coffee,” said one homeless man, who identified himself as Roy. “We are sitting down. They treat us decent. They are not putting a tag on us, calling us bums, calling us scum.”

Roy was among the roughly 40 people who took part in program Sunday in the downtown church’s Fellowship Hall. Barbara Barker, a First United member and coffee and conversation volunteer, said the church started the program about four years ago because of the growing number of homeless people asking for the coffee and doughnuts that are served to churchgoers after the Sunday service.

Barker said the program offers a safe place to have a meal and talk, and the only expectation is that guests behave civilly.

“We are not evangelizing them,” said Bob Harper, another First United member and program volunteer. “We are showing them that we love them.”

Barker said 40 to 120 people show up on a Sunday, depending on the time of the month. She said the numbers are lower in the beginning of the month because the homeless have cashed their disability checks. The majority of the people are chronically homeless, but everyone is welcome.

Barker said the program is part of First United’s radical hospitality, which includes its involvement with Family Promise of Greater Modesto. Family Promise is a nationwide network of churches and others helping homeless families. About a dozen congregations make up the local network.

The homeless in Modesto often have drawn complaints in recent years about aggressive panhandling, being drunk in public, vandalism and urinating and defecating in public. A First United Methodist Church member recently raised concerns about such behavior at her church with the city.

Harper and Barker said the coffee and conversation program does not have those problems. They said on rare occasions program volunteers have had to ask someone to leave because he or she is not treating others with civility.

Mobile devices pose data breach threats

McVey Insurance, CA, Data breachesThe widespread use of smartphones and tablets in the workplace is exposing more and more businesses to liability for sensitive data being compromised if these devices are lost, stolen, or hacked. How can your company protect itself against this threat – and how much authority do you have over an employee’s personal device if it’s also used for work-related activities?

What’s more, because these gizmos are small and portable, it’s easy to misplace them. (The federal Transportation Safety Administration recently leased a warehouse just to store those misplaced or left behind at airports.)

Another emerging risk linked to these devices is a “bring your own” policy that many companies have adopted as a way to save costs by having employees spend their own money on smartphones and tablets that are constantly evolving and updated. This approach raises questions about separating company data from personal information on the device. For example, when an employee leaves, does a business have the authority to wipe the information from his or her smartphone? According to some authorities, if an employee connects a personal device to a company network, the company has inherited responsibility for the data stored on it.

To deal with this risk, you need to provide every employee who uses these devices with training, updated annually, on how to respond in case of loss or theft. To minimize potential liability for lawsuits by customers and clients, make sure that the individual responsible for the mishap informs management immediately. The compromised information might include everything from sensitive data (financial or medical) contacts, photos, call history, personal notes – you name it.

You can also use insurance to protect yourself against losses from data breaches. A policy will provide Liability coverage that deals with legal costs and third-party expertise (such as forensics firms to analyze a breach and call centers to provide information and public relations. Coverage might also include services such as access to tools to estimate costs, a checklist for your planned response to a data breach, and access to experts who can answer questions and review your company’s policies and procedures.

Anna Bretan makes history with overall win at Modesto Marathon

McVey Insurance Agency, Modesto, CA, MarathonAnna Bretan not only successfully defended her women’s title in the Modesto Marathon on Sunday, but did so in historic fashion, setting a course record while beating all the male racers to the finish line to become the first woman to win the overall race.

Bretan, 30, completed the 26.2 miles unofficially in 2 hours, 41 minutes, 52 seconds to eclipse her own course record by nearly two minutes.

Fresno’s Matthew Klundt won the men’s race in an unofficial time of 2:44:27 to claim his first marathon victory in 10 tries.

Turlock’s Miguel Nuci won the half marathon in a record 1:11:07, shaving about 13 seconds off his previous course mark despite having to run an extra minute when a course marshall tried to get Nuci to turnaround at the midway point.

Kristi Rossi, a 45-year-old mother of three from Hillsborough who finished fourth in her age group at last year’s Boston Marathon, set a record while winning the women’s half marathon.
